Aim of the Course

At the end of this two day course medical practitioners seeking S12 (2) approval will have sufficient knowledge of the Mental Health Act 1983, Code of Practice and other relevant legislation to enable them to make medical recommendations in support of an application for detention under Part 2 of the Mental Health Act 1983.

​

The other roles a S12(2) doctor may perform, namely recommendations for guardianship and provision of reports under Part 3 are not required to be covered in any detail. Doctors who will be required to undertake such functions (particularly with regard to Part 3) are advised to seek appropriate additional training.

The online course consists of self-directed e-Learning modules with an interactive webinar on the second day. The self-directed e-Learning modules are sent in advance and should be completed by end of the first day of the course. The interactive webinar sessions are led by OxCME senior tutors. The course uses real and complex case studies, interactive quizzes, mini-lectures, small-group break-out sessions, practical exercises and legal updates to ensure delegates are fully equipped to take on the role of Section 12 doctors.

Course Objectives

​

  • To have a broad understanding of the provisions contained in Part 2 MHA relevant to the initial detention of a patient under Section 2, 3 and 4.

  • Be able to describe the role of a S12 (2) doctor and that of others when undertaking a MHA assessment.

  • Understand the meaning of, and be able to refer to, the criteria for detention under part 2 when making a medical recommendation.

  • Be able to describe the guidance contained in the Code of Practice relevant to the role and responsibilities of a S12(2) doctor when undertaking a MHA assessment.

  • To use knowledge of the impact that an assessment may have on patients and their carers to inform the approach to an assessment.

  • Be able to complete the statutory forms lawfully.
